This relatively new FAR subpart (April 2011) requires market research in these cases to determine if a commercial item, or in its absence a nondevelopmental item, is available to meet the government's requirements.
The wording of the subpart, and DCMA'S interpretation so far, seems to apply this requirement only when actual items (not services) are being purchased. This was to be anticipated given DCMA's usual reluctance to accept services as commercial items without significant objective evidence.
